Your contract is with [ Natalia Byng ] (“we”, “us” and “our” in these Booking Conditions) for the property known as [Baragwainaith] (“the Property”).  References to “you” or “your” are references to the person making the booking and all members of the holiday party.  

These Booking Conditions form the basis of your contract with us so please read them carefully.  Nothing in these Booking Conditions affects your normal statutory rights.

1.        Making your booking


Your booking is made as a consumer for the purpose of a holiday and you acknowledge that no liability can be accepted for any business losses howsoever suffered or incurred by you.

Once the completed booking and the deposit have been received and accepted by us, we will issue you with our written confirmation.  The contract between us will only be formed when we send you our written confirmation and is subject to these terms and conditions.  

We reserve the right to refuse any booking prior to the issue of our written confirmation.  If we do this we will promptly refund any money you have paid to us.

You should carefully check the details of our written confirmation and inform us immediately of any errors or omissions.

The Property may not be occupied by persons other than those named on the booking form. The hirer shall not part with possession of the property or share it except with members of the party named on the booking form

2.        Paying for your booking


If a booking is made 8 weeks or more prior to the Rental date, you will be required to pay as follows:

-       On booking, 50% deposit

-       12 weeks prior to the Rental the remaining balance of the Rental rate

-     12 weeks prior to the Rental a separate security deposit of £300 (refundable provided there is no damage)

Payment can be made direct into our bank account .

You are required to send to us your payment for the balance of the Rental and the Security Deposit at least 12 weeks prior to the Arrival Date as set out in our written confirmation.  Non-payment of the balance of the rent by the due date shall be construed as a cancellation of the contract and the Owner shall be entitled to keep the  deposit.

We will hold the Security Deposit to be applied against the reasonable cleaning and/or replacement of the property, furnishings, fixtures and fittings.  We will return the Security Deposit to you within 14 days of the return of the keys to us, less any deductions in accordance with the conditions listed above.

3.        If you cancel or amend your booking


If you need to cancel or amend your booking you must telephone us on 07957458889.

If cancelling, you will also be required to confirm your cancellation in writing or by email to  A cancellation will not take effect until we receive written confirmation from you.

If you cancel your booking within 48 hours of receiving our written confirmation, we will refund the balance of any money you have paid us.

After such period, if you cancel your booking more than 12 weeks prior to the Arrival Date, we will retain the Initial Deposit and refund the balance of any money you have paid to us.

If you cancel your booking less than 12 weeks prior to the Arrival Date, we reserve the right to retain the Initial Deposit and the balance payment in full.  If we are able to re-let the property, we will refund the balance payment to you (less any additional costs incurred, including discounts offered to sell the week(s) concerned or re-advertising costs and other administration costs or fees).  

We recommend you take out travel insurance to protect you in the event you need to cancel your holiday.

4.        If we cancel or amend your booking


We would not expect to have to make any changes to your booking, but sometimes problems occur and we do have to make alterations or, very occasionally cancel bookings.

If this does happen, we will contact you as soon as is reasonably practical and inform you of the cancellation or the change to your booking and, if it is necessary to cancel your booking, we will refund the balance of any money you have paid us. You will have no claim against us for damages or compensation, including but not limited to consequential loss, as a result of such cancellation.

5.     Covid 19


In the event national or local lockdown that prevents travel, we will transfer your booking to another available date. If this isn’t possible or suitable, we will issue a refund less any incurred charges.


In the event you have to self isolate or have Coronavirus, we respectfully ask that you follow rules and do not travel. In these circumstances, as with any illness, we would ask that you claim on your travel insurance. 


You will be required to follow the Covid safe cleaning protocols we have in place at the house, including striping all beds, placing all linens in bags and throwing out all rubbish and recycling. Failure to follow these rules can result in your security deposit being forfeited.


6. Your accommodation


You can arrive at your accommodation after 18:00 hours on the Arrival Date of your holiday and you must leave by 9:00 hours on the Departure Date.

Please note if you fail to vacate the Property by the aforementioned time (unless otherwise agreed), we reserve the right to retain some or all of your security deposit. Late departure causes problems for our cleaning staff who have a limited time to turn the house around for the incoming guests. These times have been extended as a response to Coronavirus.

A late departure fee will be charged at £30 an hour if the Hirer fails to vacate the Property on time.

In low season, we may be able to offer a different arrival or departure time for a small fee. Please let us know if this is something you would require.

6.        Your obligations


You agree to comply with these terms and conditions, and any other regulations reasonably made from time to time and ensure that they are observed by all members of your party.

You are also advised to make yourself aware of safety instructions at the property, locations of emergency equipment and read the instructions for use for fire extinguishers/fire blankets. For reasons of safety guests should carefully read the method of use and safety instructions for the swing and slide and the wood burning stove (prior to lighting).

You agree to keep and leave the Property and the furnishings, kitchen equipment, crockery, glasses, clean and in good condition. Should it be found that an excessive amount of cleaning is required a charge will be made.

You agree not to cause any damage to the walls, doors or windows of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties.

You agree to take all necessary steps to safeguard your personal property. No liability to you is accepted in respect of damage to or loss of such property, except where the damage or loss is caused by our negligence.

You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).

You cannot allow more people to stay in the Property than expressly authorised (a maximum of 6 plus a baby in a cot), nor can you significantly change the makeup of the party during your stay in the Property, nor can you take your pet into the Property. We operate a strict no smoking policy. If you do any of the aforementioned, we can refuse to hand over the Property to you, or can require you to leave it. We will treat any of these circumstances as a cancellation of the booking by you.

You agree to allow us or any representative of ours access at any reasonable time during your stay for the purpose of essential repairs.

7.        Miscellaneous



Children are very welcome at Baragwainaith. A highchair, travel cot and stairgates are included as well as children’s plastic plates, cups and cutlery. Please bring your own cot bedding.


We regret we do not take bookings for groups under the age of 25.


It is recommend that the Hirer takes out insurance to cover the cost of events such as losses, damage to personal belongings and cancellation.

Personal belongings

Baggage and personal belongings are at the Hirer's risk and no responsibility can be accepted for loss of or damage to such items


The Hirer and other members of the party must not cause an annoyance or become a nuisance to occupants of the neighbouring properties. Under these circumstances we reserve the right to terminate the agreement and ask The Hirer and all guests to leave. No compensation shall apply for the interruption of the holiday


The Property Owner or their representatives shall be allowed access to the property at any reasonable time during the holiday occupancy. In case of emergency immediate access must be permitted


We regret we do not accept Pets at Baragwainaith. Should you be found to have brought a pet into the house, you will forfeit your entire damage deposit and the Property Owner reserves the right to cancel the booking and require you to leave the Property.


Baragwainaith is strictly non smoking throughout. Should you be found to have smoked in the house, you will forfeit your entire damage deposit and the Property Owner reserves the right to cancel the booking and require you to leave the Property.


Internet Connection

Please note that use of the internet connection we provide is subject to your acceptance of the terms and conditions of the Internet Service Provider (ISP) BT and a fair use policy applies. 

Please note that we are only responsible for the provision of the connection and we advise that you take steps to ensure your own safety on-line. These include installing a personal firewall and up-to-date antivirus software before using this connection. Parents are advised to supervise their children. Illegal downloads including copyright infringement are not permitted.

We are unable to fully guarantee this third party supply


Baragwainaith is in a secluded cliff top hamlet. Please respect our neighbours and keep noise to a sensible level. Please take care not to leave any litter in the garden or around the hamlet

Breach of Conditions

If there is a breach of any of these conditions by the Hirer or any of their party, we reserve the right to re-enter the property, terminate the booking and ask the Hirer and their party to leave

We take very good care to ensure the accuracy of the property descriptions. All information is given in good faith and believed correct at the time of printing. We cannot be held responsible for any errors or omissions.

8.        Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any cause for complaint it is important that remedial action is taken as soon as possible.

It is essential that you contact us if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve difficulties properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence will usually enable shortcomings to be rectified straightaway. In particular, complaints of a transient nature (for example, regarding preparation or heating of the Property) cannot possibly be investigated unless registered whilst you are in residence.

If any complaint cannot be resolved during your holiday, you must write to us with full details within 28 days of the end of it.

9.        Our liability

Our maximum liability for losses you suffer as a result of us acting in breach of these terms and conditions is strictly limited to the Rental price you paid for your holiday and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your booking is accepted by us. 

This does not include or limit in any way our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.


10.     Law

The contract between you and us is governed by the law of England and Wales and we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Courts of England and Wales.

By continuing with your booking you are confirming you have read and agree the terms and conditions of booking for you and all members of your party.
